1. Overview

  • These Terms and Conditions form part of the agreement between you (“the Guest”) and Sea Notes Yamba (“the Property” or “the Operator”). By booking and/or staying at the Property, you agree to abide by these Terms, the NSW Short-Term Rental Accommodation Code of Conduct (2021), and the conditions set out in your booking confirmation.

2. Booking and Payment

  • A 50% deposit is required at the time of booking to secure your reservation.
  • The remaining balance is due no later than 14 days prior to check-in.
  • Bookings made within 14 days of arrival require full payment at the time of booking.
  • Payments are processed securely via Lodgify or authorised OTA platforms.
  • No security bond is required, however guests remain responsible for any loss or damage caused during their stay.

3. Cancellation Policy

  • Cancellations made more than 30 days before check-in will receive a full refund of any amount paid.
  • Cancellations made between 14 and 30 days before check-in will forfeit the deposit.
  • Cancellations made within 14 days of arrival, or failure to arrive, will result in the total booking amount being non-refundable.
  • No refunds will be provided for early departure or shortened stays.
  • Travel insurance is recommended to cover unforeseen events.

4. Check-in and Check-out

  • Check-in: From 3:00 pm
  • Check-out: By 10:00 am
  • Early check-in or late check-out may be available by prior arrangement only.
  • Guests will receive detailed arrival instructions, including key access information, prior to check-in.

5. Use of the Property

  • Guests agree to use the Property solely for short-term residential accommodation purposes and to comply with all NSW STRA Code of Conduct obligations, including:
  • Respecting neighbours and maintaining a low noise level, particularly between 10 pm and 8 am.
  • No parties, gatherings, or events are permitted at any time.
  • Only registered guests listed on the booking may stay overnight.
  • The Property is non-smoking indoors.
  • One well-behaved dog may be permitted by prior approval only (refer to your booking confirmation).
  • Failure to comply may result in immediate termination of the stay and removal without refund.

6. Property Condition and Guest Responsibility

  • Guests are expected to leave the Property clean and tidy on departure.
  • Any damage, breakage, or excessive cleaning requirements may result in additional charges.
  • Please notify the Operator promptly of any issues or maintenance concerns during your stay.

7. Maximum Occupancy

  • The maximum occupancy is 7 guests, as stated in the booking listing. Exceeding this limit breaches these Terms and the NSW STRA Code of Conduct.

8. Liability

  • The Operator accepts no responsibility for personal injury, loss, or damage to guests’ personal property during the stay.
  • Guests are responsible for securing their belongings and ensuring the Property is locked when unattended.

9. Photography and Marketing

  • By booking, guests consent to the Operator capturing and using general imagery of the Property for marketing and social media purposes. Guests will always be contacted for approval prior to sharing any identifiable photos that include them.

10. Privacy

  • Personal information provided in the booking process will be used solely for managing reservations and guest communication in accordance with the Privacy Act 1988 (Cth).

11. Breach and Termination

  • The Operator reserves the right to cancel or terminate a booking immediately if guests breach these Terms, the NSW STRA Code of Conduct, or any local council regulations. No refund will be provided in such cases.

12. Governing Law

  • These Terms and Conditions are governed by the laws of New South Wales, Australia, and any disputes shall be resolved in accordance with those laws.
